Acceptance of Offer
If you elect to accept one of our product offerings by submitting and completing a transaction with one of our customer service representatives, you are authorizing Family Calling Plan (FCP) to collect all funds associated with that transaction. If we are unable to verify or collect funds, we reserve the right to immediately terminate service without notice. At such time, all unused minutes will expire immediately. Please see Right to Refuse or Revoke Service for more information.

Cancellation Policy
You may elect to cancel your agreement with FCP at any time. Upon cancellation, you will have 30 days to finish using all of your remaining time. Any unused time remaining 30 days after cancellation will expire.

Expiration of Minutes
Monthly Family Calling Plans: Unused minutes do not expire for as long as you remain a FCP customer in good standing. If you do not use your allotted time within the given month, the unused portion will "roll-over" into the next month, and will be available for your use at any time. When you cancel your account, you will have 30 days to use any remaining minutes. 30 days after account cancellation, your minutes will expire.

PerfectCents® is a registered trademarks of Family Calling Plan, LLC (FCP) and is protected under U.S. copyright laws. This site, or any parts within, including graphics, navigation, contents or code cannot be reproduced without the expressed written permission of the owner as defined above.

Limitation of Liability
NEITHER FCP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATED PARTNER COMPANIES SHALL BE LIABLE FOR ANY DAMAGE OR LOSS, WHETHER DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL (INCLUDING LOST PROFITS), ARISING OUT OF OR RESULTING FROM YOUR USE OF FCP'S PERFECTCENTS® SERVICES OR POSSESSION OF THE FCP PERFECTCENTS® CARD, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRACT OR OTHERWISE. THE SERVICES PROVIDED BY FCP ARE DERIVED FROM THIRD PARTY SOURCES DEEMED RELIABLE, BUT FCP AND ITS AFFILIATES SHALL NOT BE RESPONSIBLE OR HAVE ANY LIABILITY FOR ANY INJURY OR DAMAGES CAUSED BY DELAYS OR INTERRUPTIONS OF SERVICES FROM WHATEVER CAUSE. YOU AGREE TO INDEMNIFY FCP AND ITS AFFILIATES AND HOLD THEM HARMLESS AGAINST ANY LOSS, CLAIM, DEMAND OR EXPENSE (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING IN CONNECTION WITH YOUR USE OF THE FCP SERVICES. IF THE FOREGOING LIMITATION IS HELD TO BE UNENFORCEABLE, THE MAXIMUM LIABILITY OF FCP AND ITS AFFILIATED COMPANIES TO YOU SHALL NOT EXCEED THE AMOUNT OF THE FEES PAID BY YOU FOR THE FCP SERVICES. THE REMEDIES AVAILABLE TO YOU AGAINST FCP OR ANY OF ITS AFFILIATED COMPANIES UNDER THIS AGREEMENT ARE EXCLUSIVE. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

Rates
Our domestic and international long distance rates are subject to change at any time with or without notice. All rates are subject to local, state, or federal government-mandated sales taxes or imposed fees.

NOTICE: The FCC Second Order on Reconsideration in CC Docket No. 96-128 requires FCP to remit a surcharge for every call placed from a payphone. On February 6, 2001, FCP began charging $0.38 for every completed call initiated from a payphone.

Right to Refuse or Revoke Service
FCP reserves the right to cancel or deny service to anyone that, in FCP's sole opinion, is attempting to fraudulently obtain our service or free time offers by the use of invalid or stolen credit card or bank account numbers, incorrect telephone numbers or by any other means that FCP may determine. Furthermore, FCP reserves the right to reject any claim for refund or calling time that FCP determines, in its sole opinion, that such a claim is through the use of invalid, stolen or misrepresented telephone numbers, credit card or bank account numbers.

Satisfaction Guarantee
The free calling time issued at the time of sale is so our customers can start experiencing the convenience and savings our products offer. We trust you will enjoy the PERFECTCENTS® service, but if for any reason you are not completely satisfied, simply call Customer Service and we will stop any FUTURE billing. You will have 30 days to use any remaining time on your card.

Miscellaneous
Kansas law shall govern the interpretation and enforceability of this Agreement. This Agreement, and your right to use the PerfectCents® service, will terminate upon your breach of this Agreement. If any provision of this Agreement is held to be unenforceable, then such unenforceable provision shall be deemed stricken from this Agreement, and the remaining provisions shall be enforced in accordance with their terms. In the absence of a written agreement signed by you and FCP, this Agreement is the complete agreement between you and FCP with regard to the PerfectCents®.
